On
September 26, 2000, the Superior Court for Los Angeles County appointed
the California Insurance Commissioner as liquidator of California
Compensation Insurance Company, Combined Benefits Insurance Company,
Commercial Compensation Casualty Company (successor in merger with
Commercial Compensation Casualty Company), Superior National Insurance
Company, and Superior Pacific Insurance Company, collectively the
"Superior National Insurance Companies in Liquidation." Since that
time, the California Department of Insurance Conservation and
Liquidation Office (CLO) has submitted unit statistical reports on
behalf of these companies.
In a
letter dated April 11, 2003, the CLO advised the WCIRB that after the
submission of unit statistical reports valued as of May 31, 2003, no
further unit statistical reports will be submitted on behalf of the
Superior National Insurance Companies in Liquidation. Accordingly, the
WCIRB will not receive the (a) first and subsequent unit statistical
reports for policies incepting on and after December 1, 2001; (b)
second and subsequent unit statistical reports for policies incepting
on and after December 1, 2000; and (c) third and subsequent unit
statistical reports for policies incepting on and after December 1,
1999. In addition, the CLO bas advised that effective June 30, 2003,
no further unit statistical corrections will be forthcoming for any
previously filed unit statistical reports.
In
accordance with Section III, Rule 3(f), of the California Workers'
Compensation Experience Rating Plan, experience ratings effective
on or after December 1, 2003, will exclude experience that was
developed under policies written by the Superior National Insurance
Companies in Liquidation that was not submitted on a timely basis in
accordance with the California Workers' Compensation Uniform
Statistical Reporting Plan. Experience ratings issued pursuant to
this rule will include an explanatory footnote.
