WCIRB MEMBERSHIP NOTICE

RE:   UNIT STATISTICAL REPORTING

SUPERIOR NAIIONAL COMPANIES IN LIOUIDATION

TO THE HOME OFFICE OF ALL BUREAU MEMBERS:

In a letter dated April 11, 2003 (clarified by letter dated September 23, 2003), the California Department of Insurance Conservation and Liquidation Office (CLO) advised the WCIRB that submission of unit statistical reports will be discontinued for the Superior National Insurance Companies in Liquidation.

These companies include:

• California Compensation Insurance Company
• Combined Benefits Insurance Company
• Commercial Compensation Casualty Company (successor in merger with Commercial Compensation Casualty Company)
• Superior National Insurance Company
• Superior Pacific Insurance Company

In a May 7, 2003, Membership Notice, the WCIRB advised its members that it would begin issuing experience modifications effective December 1, 2003, excluding policy experience from these companies in accordance with Experience Rating Plan, Section III, Rule 3(f). As a result of the clarifying letter from the CLO, the WCIRB is amending the date on which the WCIRB is permitted to issue experience modifications, excluding policy experience from these companies. The WCIRB will now begin issuing experience modifications with effective dates on or after September 23, 2003, excluding policy experience from these companies.

Experience modifications issued pursuant to this rule will include a footnote that indicates the experience modification was issued on this basis. Experience modifications effective prior to the September 23,2003, date for which data has not been submitted on behalf of these companies will not be issued.
